JUDGMENT

The petitioners have approached this Court with the following prayers :

"i. Issue a writ of mandamus or such other writ, direction or order compelling the 3rd respondent to consider Ext. P3 application affording an opportunity of hearing to the petitioner within a time frame fixed by this Honourable Court.

ii. Issue such other writ, direction or order as is deemed just and necessary in the facts, features and circumstances of the case.

2. The learned counsel for the petitioners submits that the mistake occurred in the resurvey has been sought to be rectified and that the petitioners will be satisfied, if a direction is given to the third respondent to consider and pass appropriate orders on Ext. P3 representation preferred by the petitioner within a reasonable time, after giving an opportunity of hearing to the petitioner.

3. Heard the learned Government Pleader as well, who submits that Ext. P3 can be caused to be considered in the light of Ext. P5 report of the Village Officer.

4. Considering the limited nature of relief sought for, this Court does not find it necessary to adjudicate the matter on merits. The Writ Petition is disposed of, directing the third respondent to consider and pass appropriate orders on Ext. P3 representation, in accordance with law and in the light of Ext. P5 report of the Village Officer and such other relevant materials, if any, after giving an opportunity of hearing to the petitioner, at the earliest, at any rate, within two months from the date of receipt of a copy of this judgment.

Petitioner shall produce a copy of this judgment along with copy of the writ petition before the third respondent for further steps.
