JUDGMENT
Petitioner is an Anganwadi worker working on temporary basis under various Anganwadies. Grievance of the petitioner is regarding non-appointment of her to the post of Anganwadi worker against the existing vacancy. Petitioner was arrayed as rank No.6 in Ext.P1 seniority list. It is admitted that up to rank No.5, appointments were given based on government order and petitioner will be considered for the next arising vacancy under the third respondent. 2.
It is stated in paragraph 6 of the statement filed by the third respondent as follows:
"It is respectfully submitted that the daughter of the deceased worker has passed SSLC examination and can be appointed as Anganwadi worker. Further, it is submitted that since, the petitioner has also passed S.S.L.C examination, she can only be appointed as anganwadi worker. So, at present, there is no vacancy to accommodate the petitioner. As and when vacancies arise petitioner could be given appointment. It is submitted that as per the relevant Government orders on the subject, candidates applying under the dying-in-harness scheme is having the better claim than the persons
W.P(C).No.32479 of 2014 in the seniority list. So the existing vacancy at Centre No.10 was given to the persons under the dying-in-harness scheme."

In view of the facts and circumstances, petitioner shall be considered for appointment to the post of anganwadi worker in the next arising vacancy under the third respondent. The Writ Petition is disposed of.
