JUDGMENT

The petitioner, who is faced with a demand of electricity charges from the respondent Board, by Exts.P3 and P4 notices, seeks only the grant of installments to discharge the liability under the said notices.

I have heard the learned counsel appearing for the petitioner as also the learned Standing Counsel appearing for the respondents.

On a consideration of the facts and circumstances of the case and the submissions made across the bar, and taking note of the plea of financial hardship urged on behalf of the petitioner, I dispose the writ petition with following directions: (i) The total amount due to the respondent Board as seen from Exts.P3 and P4 is Rs.4,24,150/-. Accordingly, if the petitioner remits the aforesaid amount of Rs.4,24,150/- together with accrued interest in three equal and successive monthly installments commencing from 15.11.2015, then further proceedings for

-2recovery pursuant to Exts.P3 and P4 notice shall be kept in abeyance.

(ii) It is made clear that if the petitioner commits a default in respect of any of the installments, he will lose the benefit of this judgment and the respondent will be free to continue the recovery proceedings against him from the stage at which they presently stand.
