All that the petitioner prays is for easy instalments to pay the amount due and to defer the proceedings for sale in the meanwhile. The second respondent Bank itself bid the property of the petitioner in auction in the sale conducted. The petitioner want re-conveyance of the property on her depositing the amount due in instalments.
2. I permit the petitioner to pay the amount due (inclusive of expenses incurred for sale) in 5 equal monthly instalments. The instalments shall start from 2.3.2015 and the failure to remit any one instalment will empower the Bank to deal with the property as it decides.
The Writ Petition is disposed of.
