Heard the learned counsel for the petitioner and the learned Government Pleader.
2.
Petitioner has come up in the writ petition praying for police protection against the illegal acts and threats of 3rd respondent and his agents with regard to his property of 50 cents of land. Petitioner's case is that 3rd respondent without any right has started digging and excavating earth. Complaint was submitted to the police authorities on 26/10/2015. 3.
Learned Government Pleader after obtaining instructions submits that after complaint was received from the petitioner, police immediately went to the spot and found that there is some dispute regarding the property as to whether it is a puramboke or not. Learned counsel for the petitioner vehemently denies that the property is a puramboke land. In this writ petition
W.P(C) No.34149/15 -:2:- filed for police protection, we cannot adjudicate over the nature of the land. Petitioner is free to seek civil or criminal remedy as available under law against the alleged action of the 3rd respondent.
With these observations, this writ petition is closed. Sd/- ASHOK BHUSHAN, CHIEF JUSTICE Sd/- A.M. SHAFFIQUE, JUDGE Rp 17/11/2015 //True Copy// PS to Judge
