JUDGMENT
Ext.P5 order rejecting the application put in by the petitioner for redetermination of the compensation under Section 28A of the Land Acquisition Act, 1984 is impugned. The application is seen rejected for the reason that the same was not accompanied by a certified copy of the award relied on. 2.
This Court by Ext.P8 judgment has held that it is not necessary to produce a certified copy of the award along with the application for redetermination of compensation amount. This is however subject to the condition that the application is filed within the period of three months stipulated in the proviso to Section 28A of the Land Acquisition Act, 1984. 3.
Ext.P4 award is seen passed on 19.11.2011 and the application under Section 28A of the Land Acquisition Act, 1984 was filed on 31.01.2011. There is therefore no justification on the part of the first respondent in dismissing the application put in by the petitioner on the ground of delay.

The respondents however maintain that Ext.P4 award under Section 20 of the Legal Services Authorities Act, 1987 is on the basis of a settlement only. Whether such an award could be the basis for an application under Section 28A of the Land Acquisition Act, 1984 is a matter to be decided by the first respondent.

I quash Ext.P5 order and direct the first respondent to reconsider the application dated 31.01.2011 put in by the petitioner for redetermination of the compensation. The same shall be done with notice to the petitioner and within a period of two months from the date of receipt of a copy of this judgment. The Writ Petition is disposed of.
