Dated this the 24th day of November, 2015 J U D G M E N T The petitioner has approached the respondents with Ext.P5 application seeking a refund of amounts paid by the petitioner to the respondents. It is the case of the petitioner that consequent to his appeal against Ext.P1 order being allowed by the appellate authority he become entitled to substantial amounts by way of refund and it is for the said refund that he has preferred Ext.P5 application before the 1st respondent as early as on 20.01.2015. In the writ petition, the petitioner is aggrieved by the delay occasioned by the respondents in considering the refund application.

2. I have heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

3. On a consideration of the facts and circumstances of the case and the submissions made across the bar, I dispose the writ petition with a direction to the 1st respondent, before whom Ext.P5 application filed by the petitioner seeking refund of excess tax paid, is pending to consider and pass orders on the same within a period of one month from the date of receipt of a copy of this judgment, after hearing the petitioner.
