Dated this the 17th day of November, 2015 J U D G M E N T The petitioner, who is faced with recovery streps for recovery of amounts confirmed against him by an order of the Consumer Redressal Forum seeks the facility of instalments to discharge the liability fastened on him.

2. I have heard the learned counsel appearing on behalf of the petitioner and the learned Government Pleader for the respondents.

3. On a consideration of the facts and circumstances of the case and the submissions made across the bar, I dispose the writ petition with the following directions:- (i) If the petitioner pays the amounts demanded (Rs.3,70,000/- together with accrued interest and other charges) as shown in Ext.P2 notice issued to him in four equal and successive monthly instalments commencing from 10.12.2015, then further proceedings for recovery shall be kept in abeyance.

(ii) It is made clear that, if the petitioner commits a default in respect of any of the

instalments, he will lose the benefit of this judgment and the respondents will be free to continue the recovery proceedings against them from the stage at which they presently stand. (iii) The respondents shall verify, if any amount has been paid by the petitioner pursuant to Ext.P2 demand notice issued to him, and if any such payment has been made then the respondents shall give due credit to the said payment also.
