JUDGMENT

The petitioner, a daily wage employee, appointed as a driver in the erstwhile Hindu Religious and Charitable Endowment (HR&CE) Department, is aggrieved with the termination attempted at Ext.P5. The learned Standing Counsel for the Board submits that the petitioner's appointment as a daily wage employee was in the erstwhile Board and after the present Malabar Devaswom Board was constituted, he was appointed in a scale of pay and regularisation was sought for by Ext.P4, which was said to be pending before the first respondent.

In such circumstance, it is only proper that the first respondent consider Ext.P4 and till then, the petitioner shall be continued. Ext.P5 shall be kept in abeyance. There shall be a direction to the first respondent to issue notice to the

W.P(C). No.35549 of 2015-P petitioner and the Malabar Devaswom Board and consider Ext.P4 within a period of three months from the date of receipt of the certified copy of this judgment. The writ petition is disposed of.
