JUDGMENT
Against the first revisional order passed in penalty proceedings, the petitioner has preferred Exts.P6, P7 and P8 second revision petitions along with Exts.P9, P10 and P11 stay petitions before the 2nd respondent. The limited prayer of the petitioner is essentially for a direction to the 2nd respondent to consider and pass orders on Exts.P6, P7 and P8 revision petition itself, without insisting on pre-deposit of amounts confirmed in the penalty orders, since in the appeals against the assessment orders, Ext.P4 order was passed setting aside the demand against the petitioner and remanding the matter for fresh consideration by the assessing authority. It is pointed out that the penalty orders were passed relying solely on the assessment orders, which have since been set aside by the appellate authority.

I have heard the learned counsel appearing for the petitioner as also the learned Government Pleader appearing for the respondents.
On a consideration of the facts and circumstances of the case as also the submissions made across the bar, and taking note of the

No. 35916 of 2015 fact that the penalty orders were passed based on the findings in the assessment orders, which have since been set aside by the appellate authority, I direct the 2nd respondent to consider and pass orders on Exts.P6, P7 and P8 revision petitions on merits, after hearing the petitioner, within a period of three months from the date of receipt of a copy of this judgment. I make it clear that, till such time as the 2nd respondent passes orders as directed in the revision petitions, coercive steps for recovery of amounts confirmed against the petitioner by Exts.P1 to P3 penalty orders, shall be kept in abeyance.
