J U D G M E N T
The petitioner approached this Court on account of the fact that the first respondent refused to accept notice issued u/s 5 of the Special Marriage Act.

The learned Government Pleader on instructions submits that the petitioner did not appear and furnish any notice.

This stand of the first respondent has been strongly refuted by the counsel for the petitioner. Taking note of the fact that the petitioner is intent to marry under the special marriage Act, the first respondent is directed to receive notice from the petitioner without insisting any condition. If the fist respondent finds that any defect exists in respect of the notice necessarily that shall be responded in writing.
