JUDGMENT
The petitioner seeks further time to produce Transfer Certificate for getting admission to the M.Phil. course. The petitioner applied under Exhibit P2 notification and was also selected for admission; but, however, is unable to join the course since the petitioner could not produce Transfer Certificate from the institution in which she was studying. The petitioner is undergoing B.Ed. course in the 2nd respondent's College. The petitioner contends that there is one more month remaining to complete the B.Ed. course and she should be granted time till January 2016 to produce Transfer Certificate and get admission to the M.Phil. course. The petitioner also relies on the specific condition in Exhibit P2 that three months time would be granted to candidates who are awaiting their results.
2. No reliance can be placed on Exhibit P2 since the time granted therein is for production of the mark-list of the qualifying examination and not for production of Transfer Certificate. The petitioner has to choose either of the two
WP(C).No.36994 of 2015 - 2 - courses. Whether she wants to continue the B.Ed. course or take admission to the M.Phil. course, is her option, but the University cannot be asked to wait, especially since the course has already commenced. The petitioner having not produced Transfer Certificate, is deemed to have been decided to continue the B.Ed. course. There are other eligible candidates who have Transfer Certificate and who are willing to get admitted to the M.Phil. course in the University. It is also submitted by the learned Standing Counsel for the University that admission of two other candidates were also rejected for the same reasons and admissions cannot be kept pending for the convenience of the students. It is also submitted that already the next eligible person has been granted admission in the place of the petitioner. The classes for the M.Phil. is also stated to have been commenced on December 03, 2015.
For all the above reasons, the petitioner's contentions are found to be untenable and hence rejected. The writ petition would stand dismissed in limine.
