JUDGMENT
The petitioner is the holder of the building permit issued by Chalakudy Municipality. It appears that the petitioner without obtaining necessary environmental clearance and quarrying permit had removed the ordinary earth from the site covered by the building permit. The petitioner approached the respondent-Geologist for O.A. Forms, this has been refused.
2. The petitioner's case would not fall within Rule 14 of 106 under the Kerala Minor Mineral Concession Rules. However, it appears that the petitioner's bonafide had removed the earth from the site covered by the building permit.
3. This Court is of the view that the Geologist shall conduct inspection to find out the act of the petitioner is
W.P.(C).No. 38336 of 2015 -2bonafide. If it was bonafide, necessarily after collecting a royalty and also imposing a fine and also collecting compounding fee, necessary O.A. Forms shall be issued to the petitioner. Needful shall be done within a period of two weeks from the date of receipt of a copy of this judgment. The writ petition is disposed of as above.
