J U D G M E N T

The petitioner has approached this Court challenging Ext.P5 direction of the District Collector, Kasargode directing the petitioner to remit Rs.5,32,480/- being the value of the vehicle ordered to be confiscated under the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. The petitioner had approached this Court on an earlier occasion and this Court was of the view that the petitioner had a remedy by way of an appeal before the concerned District Court. Ext.P4 is the judgment in the aforesaid writ petition.

If the petitioner wants to release the vehicle, necessarily, the petitioner has to deposit the entire amount. However, the petitioner is free to challenge the order as observed in the earlier

W.P.(C).No.38466/2015 -:2:- judgment. The direction in Ext.P5, to confiscate the vehicle for non remittance of the amount stated therein, is deferred for a period of two weeks. The writ petition is disposed of as above. No costs.
