J U D G M E N T

The petitioner submits that he has applied for assignment of land as per Ext.P1 application in respect of a land comprised in Re-survey No.436/1 Pt. in Block No.22 of Arckapady Village, Kunnathunad Taluk, Ernakulam District. He seeks for a direction to the respondents not to evict the petitioner from the aforesaid property.

This Court is of the view that the petitioner shall not be evicted from the aforesaid property, if he is in occupation of the same. If at all the petitioner has to be evicted, it shall be done only through the process of Land Conservancy Act and Rules.
