K.T.Sankaran, J.
The case of the petitioner is that his wife Soumya is under the illegal detention of the third respondent. When the matter came up for hearing on 31.3.2015, the parties appeared before the Mediation Centre and settled their disputes and differences and a memorandum of agreement was signed by them. Soumya agreed to go with the petitioner and the petitioner agreed to protect her. It was also agreed before the Mediation Centre that the petition would be withdrawn. The terms of settlement are the following :
"1.
The above mentioned case is settled between the petitioner and detenue. They were already married on 1.1.2015 at Kalavankodam Shakthiswaram
W.P.(Crl) No.121/2015 Temple, Cherthala and the marriage was registered in the Vayalar Grama Panchayath. Petitioner is willing to take his wife named Soumya detenue herein to his house today itself. Petitioner also undertakes that he will not torture the detenue and both family members in any way and he will take her whenever he gets a job. There is no other dispute pending between the petitioner and the detenue. Petitioner undertakes to withdraw the Habeas Corpus petition pending before this Hon'ble Court."
