Heard learned counsel for the Parties.

Order No.

The Writ Petition involves the following prayer :- "Under such circumstances the petitioner therefore prays that your Lordships would be graciously pleased to admit this writ application call for the records and after hearing the parties may be pleased to issue a writ/writs order/orders, direction(s) in the nature of mandamus directing the opposite parties to refund her security money deposited with the opp. Party no.4 dated 3.3.2003, under Annexure-3 for her appointment as computer teacher in Govt.

High School, Damana, Chandrasekharpur, Bhubaneswar under the opp. Party no.2."

This matter was admitted in 2006 with service of copy on the learned State Counsel. Even order dated 11.10.2006 discloses that the Government Counsel sought time to file counter. No counter has been filed as of now. This Court finds, the Petitioner has a claim for refund of security deposit of Rs.5,000/- on her being appointed as

// 2 // Computer Teacher in Government High School, Damana, Bhubaneswar.

Looking to the nature of request made and as there is no counter as of now, this Court directs O.P.2 to take a decision on the request of the Petitioner treating the Writ Petition as a representation at the instance of the Petitioner and the decision be communicated to the Petitioner by completing the entire exercise within a period of two months from the date of communication of this order along with copy of the Writ Petition on O.P.2.
