Learned Counsel for the Appellant inviting the attention to the memo dated 14.010.2003 already on record, submits to have no instruction in the matter to further pursue the Appeal since that time onwards. It is also submitted that despite several attempts to connect with the Appellant and take instruction, it has not been possible. He, therefore, expresses his inability to further pursue the Appeal by taking part in the hearing.

In view of the above, the Appeal stands dismissed for non-prosecution.
