1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 18th November, 2021 in connection with Jarapada P.S.
Case No.305/2021 corresponding to G.R. Case No.1161/2021 pending in the court of learned J.M.F.C., Banarpal for the alleged commission of the offence under Sections 397/450/294 of I.P.C and Sections 25 and 27 of the Arms Act.

4. It is alleged that suspecting the injured to be practising witchcraft, the Petitioner along with two other persons entered into her house and assaulted the injured. One of the culprits also fired a gunshot causing injury to the injured lady. The materials on record, however, do not reveal that the gunshot was fired by the present Petitioner.
5. Having regard to the submissions made, the materials on record, the period of detention in custody and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail.
6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case and in case of any single default, the said court shall pass appropriate orders to take him to custody again.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted on proper application.
