1. It appears that with there being no stay of the impugned order of the Orissa Administrative Tribunal (OAT), which required the Opposite Party to be reinstated, he has in fact been working after reinstatement and has even got a promotion in the previous year. Orders to this effect have been shown to the Court by learned counsel appearing for the Opposite Party.

2. In that view of the matter, the questions of law are left open for decision in some other appropriate case.
