This matter is taken up through hybrid arrangement Order No.

None appears on behalf of the Appellants.

Notice having been sent to the Appellant No.1, the villagers have sated that the Appellant No.1 has died in or around the year, 2013 which has been accordingly reported. Appellant No.2 is none other than the brother of Appellant No.1. He is not coming forward to take steps for further pursuing the Appeal.

Mr. G. Mukherjee, learned Sr. Counsel for the Respondents is present.

This Appeal is of the year, 1989 and has been filed questioning the judgment and decree passed by the Title Appeal No.64 of 1984. Learned 2nd Additional District Judge, Cuttack. The First Appellate Court has thereby confirmed the judgment and decree passed by the learned Munsif, Banki in Title Suit

// 2 // No.15 of 1983. The suit is with the relief of permanent injunction simplicitor.

In view of all these above and in the above state of affair, the Appeal stands dismissed for non-prosecution. Issue urgent certified copy as per rules.
