Heard Mr. N.C. Mohanty, learned counsel for the Appellant. 3.

Present appeal is directed against the order of learned Civil Judge, (Sr. Division), Rourkela passed in Misc. Case No.4 of 1994 filed under the provisions of the Arbitration Act, 1940. 4.

Misc. Case No.4 of 1994 was filed praying to set aside the nil award dated 30th December, 1993 passed by the Sole Arbitrator. 5.

The arbitration pertains to the terms and condition of Agreement No.1 of 1975 between the parties.

Upon hearing Mr. Mohanty and perusal of the impugned order, neither any ground is found in favour of the Appellant nor is any substantial question seen involved in the appeal. As such the appeal is dismissed.
