1. This appeal has been preferred against order dated 31st August, 2002 passing decree in terms of award dated 14th August, 1995. Mr. Parhi, learned advocate, Asst. Solicitor General of India appears on behalf of appellant, while Mr. Palit, learned senior advocate appears on behalf of respondents. Respondents were claimants in the reference and award holders.

By order made this day, Court found that appeal preferred against order also dated 31st August, 2002, rejecting the petition filed by appellant under section 33, Arbitration Act, 1940, was without merit. In terms of section 17, impugned order was made pronouncing

// 2 // decree on the award. As such, there is no infirmity in impugned order warranting interference in appeal.

The appeal is dismissed.
