This matter is taken up through Video Conferencing mode. 2.
Heard learned counsel for both the parties and perused the records.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

After hearing learned counsel for the Petitioner, this Court is not inclined to release the Petitioner on anticipatory bail. However, considering the submission of learned counsel for the Petitioner that the Petitioner has no criminal antecedent and the injuries sustained by the injured are simple in nature and considering the gravity of allegations made against the Petitioner, it is directed that in the event the Petitioner surrenders before the learned S.D.J.M., Phulbani, in C.T. Case No.705 of 2021, arising out of Phulbani Town P.S. Case No.217 of 2021 and moves an application for regular bail, he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper subject to the conditions that if the injuries are found to be grievous in nature, the bail order shall stand revoked and bail application of the Petitioner shall be

The ABLAPL is accordingly disposed of.
