None appears for the Appellant at the time of call, but Mr. S.S. Pradhan, learned A.G.A., by filing the written instruction received from IIC, Model P.S., Birmaharajpur, Dist- Subarnapur along with the copy of the death certificate, submits that the sole Appellant Hrushikesh Das is already dead. Both the written instruction and the copy of the certificate may be kept on record. 3.

In view of the aforesaid, appeal against the Appellant stands abated.
