The Petitioner in this RPFAM seeks to assail the order dated 16th January, 2009 passed by learned Judge, Family Court, Cuttack in Criminal Proceeding No. 477 of 2002, whereby the Petitioner has been directed to pay maintenance at the rate of Rs.400/- per month to the Opposite Party from August, 2002 subject to adjustment of interim maintenance already paid.

Mr. Rath, learned counsel for the Petitioner submits that he has no instruction in the matter.

In view of the above, the RPFAM is dismissed for nonprosecution. Urgent certified copy of this order be granted on proper application.
