1. Learned counsel for the Petitioner seeks leave to withdraw Order No.
the writ petition with liberty to approach the Debts Recovery Appellate Tribunal against the impugned orders challenged in the present petition in accordance with law.
2. If such petition is filed not later than 1st August, 2022 accompanied by an application for condonation of delay citing the pendency of the present petition as reason for the delay, it will be considered by the Appellate Tribunal in accordance with law. The Court clarifies that it has not expressed any view in the matter. The interim order passed by this Court on 28th January, 2008 will, provided the Petitioner files the appeal within the time stipulated, continue till such time the DRAT passes an order on the application for interim relief to be filed by the Petitioner along with the appeal.
3. The writ petition is disposed of as withdrawn with the liberty prayed for in the above terms.
