1. During the pendency of the present petition filed by the Management against the impugned order of the Industrial Tribunal, Rourkela, the Opposite Party No.2-Workman has expired and has not been substituted by his legal heirs.

2. Considering that the issue has been rendered academic, the Court considers it appropriate to dispose of the petition leaving the question of law that may arise from the impugned order of the Tribunal open for consideration in some other appropriate petition.
