Bharat Ch.Panda v. Sub-Collector,Jajpu
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.11575 of 2011 Bharat Chandra Panda and others ....
Petitioners M/s. A. K. Sahoo and associates, Advocates -versusSub-Collector, Jajpur and another ....
Opposite Parties Mr. Debakanta Mohanty, AGA
CORAM:
THE CHIEF JUSTICE JUSTICE R. K. PATTANAIK Order No.
ORDER
29.03.2022 12.
1. The grievance of the Petitioners is that while in the case of the Petitioners' vendor's rent has been fixed for the land in question by the Government, it has not done so in the case of the Petitioners.
2. In terms of the Circular dated 6th December, 2000, rent could be fixed if the purchase took place prior to 25th August, 1983. Admittedly, the Petitioners' purchase was after the said date and, therefore, the denial of the same benefit to them was justified. Incidentally, the Circular dated 6th December, 2000 is not under challenge before this Court.
3. In the circumstances, there is no error to be found in the order dated 18th November, 2002 passed by the Tahasildar, Sukinda, Jajpur Road in Bebandobasta Case No.868 of 2001 or in the order
dated 5th October, 2009 passed by the Sub-Collector, Jajpur in Misc. Appeal No.2 of 2007.
4. The writ petition is accordingly dismissed. (Dr. S. Muralidhar) Chief Justice (R. K. Pattanaik) Judge M. Panda
