This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 21st December, 2010 passed by the learned J.M.F.C., Nimapara in I.C.C. No.120 of 2010 wherein cognizance has been taken under Section 217 of I.P.C. on the allegation that he has failed to discharge his official duty by not registering the report presented by the Opposite Party-Complainant with an intention to screen the other accused in the complaint case. 3.
No one appears on behalf of the Petitioner at the time of call. But, learned counsel for the Opposite Party is present. The case is of the year 2011.

As such, the CRLMC is dismissed for non-prosecution.

However, liberty is given to the Petitioner to challenge the proceeding against him at the stage of framing of charge, if charge has not been framed in the aforesaid.
