1. For the reasons stated therein, the application is allowed. The delay of 18 days in filing the present appeal is condoned. The Misc. Case is, accordingly, disposed of.

Considering that there has been no stay of the impugned order of the learned Single Judge and considering the fact that the Respondent has already attained the age of superannuation, the Court is not inclined to interfere. The question of law arising from the impugned judgment of the learned Single Judge, is left open for decision in some other appropriate case.

3. The appeal is dismissed.
