Counter affidavit has been filed on behalf of opposite party No.4.

Mr. K.P.Mishra, learned senior counsel for opposite party No.4 is present.

The writ petition has been filed assailing the appointment of Secretary of Balipokhari Grama Panchyat.

On perusal of the counter affidavit filed by the State as well as by opposite party No.4, it seen that ex-facie writ petition is not maintainable, since both the petitioners were not applicants for the post of Secretary of Balipokhari G.P., selection of which is assailed herein.

Taking note of the same, the writ petition is dismissed being devoid of merit.
