1. This matter is taken up through hybrid mode.

2. The petitioner, a Proprietorship firm had availed a term loan as well as a cash credit account facility from the opposite parties-Bank for the purpose of his business. Due to financial indiscipline the loan account was classified as Non-performing Assets (NPA) on 31.08.2019 and subsequently possession notice was issued under Section 13 (4) of the SARFAESI Act on 03.03.2021 and the auction sale was fixed for 07.01.2022.

3. Learned counsel for the petitioner files a Memo dated 10.02.2022 seeking liberty to withdraw the writ petition to pursue the remedy as available under law. Memo is taken on record.

4. The writ petition stands dismissed as withdrawn with the liberty, as prayed for.
