ORDER (Oral) 08.03.2022 03.

1. This matter is taken up through virtual/physical mode.

2. The petitioner is stated to have retired from the Armed Forces and in a marital dispute between him and his wife/Opposite Party No.1, the State Bank of India/Opposite Party No.2 had freezed the account in order to protect the claim of the wife pending before the appropriate court. Thus, the prayer in the present writ petition is for a direction to defreeze the account so as to enable the petitioner to operate his Bank account with the SBI.

3. This Court vide interim order dated 24.03.2011 had permitted the petitioner to operate the account while ordering the retention of a sum of Rs.5,00,000/- for protection of the interest of his wife.

4. At the time of hearing, learned counsel for the petitioner submits that by efflux of time the present writ petition probably has become infructuous.

5. In view of the above submission, the writ petition is dismissed as infructuous. However, liberty is granted to the petitioner to
