1. Aggrieved by a demand of enhanced premium pursuant to a Cabinet decision dated 14th December 2009, the Petitioners, who are occupying the land in Plot No.14 (SCR), Unit-VI, Ganganagar, Bhubaneswar have filed the present petition.

2. While directing notice to issue in the present petition on 6th August 2012, this Court directed status quo to be maintained. That stay order has continued for 10 years now. As a result, without having to pay the enhanced premium, the Petitioners have continued in the land pursuant to the allotment order dated 26th November, 2009.

3. Having heard learned counsel for the parties and taking note of the fact that the present market value of the land in Bhubaneswar, particularly the area in question has enhanced multifold, there would be no prejudice whatsoever caused to the Petitioners in

paying the enhanced premium as demanded at the time when the present petition was filed. Therefore, the Court is not inclined to interfere in the matter. The interim order passed earlier stands vacated.

4. The writ petition is dismissed.
