Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 30.05.2013 in connection with Chhatrapur P.S. Case No. 68 of 2013 corresponding to G.R. Case No.135 of 2013 pending in the court of learned S.D.J.M., Chhatrapur for the alleged commission of offence under Sections 120-B/420/468/471/34 of IPC read with Sections 4/5/6 of Prize Chit and Money Circulation (Banning) Act.

The allegation in so far as the present case is concerned in that the informant-Debaraj Sahu had deposited Rs.1,00,000/- in the office of the Artha Tatwa Group of which the present petitioner is one of the Director.

It is submitted by learned counsel for the petitioner that the
CMD, who has been projected as the principal accused in the case has already been granted bail by this Court in BLAPL No.2023 of 2020 and BLAPL No. 1830 of 2021, copies of which are enclosed to the bail application. It is further submitted that one Manoj Kumar Pattnaik, who is also similarly placed as the petitioner has been granted bail by this Court as per order passed in BLAPL No.1488 of 2021.

Learned Additional Standing Counsel has fairly submitted that the petitioner stands on the same footing as the said Manoj Kumar Pattnaik.

Considering the submissions as above, the materials on record, the period of detention already undergone and the fact that similarly situated co-accused persons have already been released on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail. 8.
The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
