This Court, while condoning the delay vide its Order dated 05.09.2012 in Misc. Case No. 173 of 2010, passed the following order:
"
Learned counsel for the State accepts notice on behalf of the opp.
Party/respondent.
Copy of the limitation petition is served.
Heard.
This is an application for condonation of delay of 393 days in filing the appeal.
Considering the submissions, delay in filing the appeal is condoned subject to payment of cost of Rs.1000/-(Rupees one thousand) to the High Court Bar Association Welfare Fund within two weeks from today.
Misc. case is disposed of."

Today, when the matter is listed under the heading "For Orders" with a noting that receipt showing payment of cost of Rs.1000/- to Orissa High Court Bar Association
Welfare Fund has not been received, the learned Counsel for the Appellant fairly conceded that the said cost of Rs.1000/- is yet to be paid to the High Court Bar Association Welfare Fund in obedience of the Order dated 05.09.2012 and prays to deposit the said cost in course of the day. This Court is not inclined to allow such prayer after 10 years.

Accordingly, the Appeal stands dismissed for noncompliance of the Order dated 05.09.2012. Padma/Banita (S.K. MISHRA) JUDGE
