This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 16th February, 2011 passed by the learned Additional Sessions Judge, (F.T.C.), Sambalpur in S.T. Case No.148/43 of 2010 wherein his prayer under Section 311 of Cr.P.C. for recall of P.W. 3 and 7 for further cross-examination has been rejected. 3.

No one appears on behalf of the Petitioner when the matter is called.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution.

Interim order dated 11th March, 2011 passed by this Court in Misc. Case No.248 of 2011 stands vacated. 8.
