Heard learned counsel for the Parties.

Petitioner's allegation in this Writ Petition is that the opposite party nos.1 to 3 are not re-settling the Bhogra land in their favour in pursuance of the agreement executed on 22.04.1952 between the Governor of Odisha and Sumurti Bhoi, son of late Lakshman Bhoi, who was Thikadar.

This Court is of the considered opinion that it would be proper on the part of the petitioner to approach the revenue authorities instead of rushing to this Court directly by filing this Writ Petition.

Learned counsel for the petitioner submits that he shall file representation before the Collector, Bolangir highlighting the grievance as made in this Writ Petition.

In view of the above, this Court without expressing any opinion on the merit of the case of either parties, disposes of the

// 2 // Writ Petition with a direction that if such a representation is filed within a period of one month from today, the Collector, Bolangir, opposite party no.2 shall take a decision thereon strictly in accordance with law giving opportunity of hearing to the parties concerned including opposite party No.4 to 6, as early as possible. If it is expedient, the Collector, Bolangir may obtain report in this regard from the Tahasildar, Titilagarh (O.P. No.3) and proceed with the matter in accordance with law.
