CORAM:

JUSTICE BISWANATH RATH

ORDER

11.10.2022 7.

1.

Heard learned counsel for the Petitioner.

Order No.

2.

Considering the limited nature of dispute only involving the interest aspect in the award involved herein and taking into account that there has been protection since 12.8.1999 granted in favour of the Petitioner, further taking into consideration that there has been payment of principal, even though this Court finds no material to satisfy the contention of the learned counsel for the Petitioner that interest was not included in the reference involved herein, further taking into consideration huge interest must have been accrued in the meantime, this Court while interfering with the interest aspect observes, in the event the Petitioner pays 50% of the interest amount and makes an approach to the Competent Authority for reduction in

// 2 // the interest aspect, the Authority shall do well in taking a lenient view. Let such Application be filed along with 50% of the interest amount within two weeks along with copy of this order, in which event the direction of this Court will be worked out within four weeks.

3.

The Writ Application thus stands disposed of. (Biswanath Rath) Judge M.K.Rout
