None appears for the Appellant in this Appeal of the year 1996 when called.

The record reveals that the Appeal has already been dismissed as against Respondents 4, 6, 8/b, 8/c, 10 and 12 way back by order dated 31.03.2003.

The suit is one for partition and that had been filed by this Appellant as the Plaintiff. The suit been dismissed, he having carried the First Appeal as the unsuccessful Plaintiff, has failed in that move.

In the above state of affair, the Appeal stands dismissed as to have abated in entirety. No order as to cost. (D. Dash), Judge.
