The petitioner has filed this writ petition seeking to quash the impugned letter dated 30.05.2008 under Annexure-9 passed by the D.P.C., Balasore to deposit the amount of Rs.82, 906/- as outstanding.

As it appears, the contract was executed for construction of school building under RSBP and, as such, the same has not been done in accordance with law. Thereby, direction has been given vide letter dated 30.05.2008 under Annexure-9 to deposit Rs.5084/- towards royalty and in total the liability comes to Rs.82, 906/- for final settlement of the accounts under RSBP. Therefore, unless the said amount is being deposited, the final bill cannot be made. Though this Court vide order dated 04.11.2008 passed interim order, but thereafter the matter was not listed nor has the interim order passed by this Court been extended. Therefore, in view of the direction of the apex Court contained vide order dated
02.07.2021 in M.A. Nos.1375-1376 of 2013 in Resurfacing of Road Agency Pvt. Ltd. and Anr v. Central Bureau of Investigation, whatever interim order passed by this Court on 04.11.2008 automatically expires after expiry of six months. 6.
