Heard learned counsel for the petitioner; Mr. P.R. Barik, learned counsel for opposite parties no.2 and 3; and Mr. Gurudutta Kar, learned counsel for opposite party no.4. 3.

The petitioner has filed this writ petition seeking to quash the letter dated 21.05.2014 issued by the Divisional Engineer (P&A), Office of TDM, BSNL, Udhampur and letter dated 18.06.2014 issued by the Senior Manager, Indian Overseas Bank, IRC Village Branch, Bhubaneswar and to pass order restraining opposite party no.4 to invoke the Bank Guarantee pursuant to the demands dated 21.05.2014 made by opposite party no.3. 4.

Both Mr. P.R. Barik, learned counsel for opposite parties no.2 and 3; and Mr. Gurudutta Kar, learned counsel for opposite party no.4 have contended that during pendency of the writ petition the bank guarantee has already been encashed and the account of the petitioner has been disordered. 5.

In view of the above submission, nothing remains to be

adjudicated in the present writ petition. Accordingly, the writ petition stands disposed of. However, if any cause of action still survives, the petitioner is at liberty to pursue its remedy before the appropriate forum in terms of the agreement itself. Ashok/Sukanta (DR. B.R.
