It is strange to observe that Misc. Case Nos.8090 of 2001, 8103 of 2001, 8127 of 2002, 8218 of 2002, 8219 of 2002 and 8220 of 2002, though involve substitution of Opposite Party No.6 a contesting Opposite Party and all filed in 2001 and 2002. Petitioners remain silent in listing such matters, nothing even prevented the Registry of this Court to at least bring such application on board in time. Two decades have already passed in the meantime and unless the substitution aspect is attended the Court is unable to proceed for final hearing. 2.
Considering the matter is pending over two decades, this Court permits the Petitioners to take out substitution notice on the L.Rs. of Opposite Party No.6 involving Misc. Case No. 8090 of 2001, 8103 of 2001, 8127 of 2002, 8218 of 2002, 8219 of 2002 and 8220 of 2002 by way of single paper publication in a local daily at least within ten days. Draft paper publication be filed by 23.09.2022. Draft publication be approved by Registry within two working days from the date of receipt of draft publication and the paper publication will be made within three
// 2 // days of the approval of the draft. Petitioners are also directed to file at least three copies of such publication in this Court within further three days of the publication. The publication should indicate the date of appearance and also the date of further listing of the matter immediately at least fixing date of posting to 11th October, 2022. Unless the steps as directed hereinabove is taken within the time, the matter will be dismissed for non-compliance of this Court's order without further reference to the Bench.
