Notice is sufficient as only A.D. has not come back. This Court enters into hearing of the matter.

Heard Mr.Das, learned Senior Counsel appearing for the petitioner. Undisputedly Annexure-5 proceeding has been disposed of recording the consent of the opposite parties to the claim of the petitioners. In the circumstance, this Court finds this Court is not a court to enter into the conflict as to whether the petitioners have consented for such order or not. Law has been fairly well settled settling the position that court which has committed such mistake or recording contrary to the submission of the parties need to rectify its own order. It is at this stage of the matter, Mr.Das, learned Senior Counsel seeks for withdrawal of the writ petition in order to approach the competent authority committing such mistake in appropriate application. Consequently, the writ petition is permitted to be withdrawn but however with liberty as prayed for. (Biswanath Rath) Judge sks
