This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

There is no appearance on behalf of the Opposite Party Nos.2 and 3 the contesting Opposite Parties. Learned counsel for the State has appeared on behalf of the Opposite Party No.1. 4.

The grievance of the petitioner is that though he was working as Kantabala under the District Manager, Odisha State Civil Supplies Corporation Ltd. Jeypore ignoring his legitimate claim, the authorities have appointed persons freshly recruited pursuant to advertisement.

In Paragraph-17 of the Writ Petition specific stand has been taken that the persons similarly situated were allowed to continue whereas the petitioner has been singled out for hostile discrimination.

Taking into account the limited nature of grievance of the petitioner, this Court disposes of the present Writ Petition directing the Opposite Party Nos.2 and 3 to consider the claim of the petitioner, if persons similarly circumstanced as claimed are continuing. Since the matter is pending adjudication before this Court since 2012, the authorities may do well to take a decision regarding similar benefits to be extended to the petitioner at par with others similarly circumstanced within a period of six weeks from the date of receipt/production of certified copy of this order along with copy of this Writ Petition.
