The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the F.I.R. in Gosaninuagam P.S. Case No.74 of 2011, corresponding to G.R. Case No.972 of 2011, pending on the file of the learned S.D.J.M., Berhampur. 3.

Heard the learned counsel for the petitioner and the learned counsel for the State.

Considering the facts and circumstances of the case, so also the submission advanced on behalf of the learned counsel for the petitioner, this Court is not inclined to quash the aforesaid criminal prosecution launched against the petitioner.

Hence, giving liberty to the petitioner to file appropriate petition before the appropriate forum, if in the meanwhile charge-sheet has been filed and cognizance has been taken in the aforesaid proceeding, this CRLMC stands disposed of being dismissed. Interim order dated 21.10.2011 passed by this Court stands vacated.
