1. The impugned order of the learned Tribunal was an ex parte one. On that short ground, the Court sets aside the impugned order of the learned Tribunal and remands S.A. No.74(ET) of 2012-13 to the Tribunal for a fresh determination in accordance with law.
2. The parties will appear before the Tribunal for the above purpose on 19th December, 2022. The Tribunal will then proceed with the appeal on merits and endeavour to dispose it of as expeditiously as possible. The deposit already made by the Petitioner during the pendency of the Second Appeal will continue and abide by the final decision of the Tribunal.
3. The STREV is disposed of in the above terms. A copy of this order be sent to the Tribunal forthwith.
