This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Standing Counsel.

The Petitioner has filed the present writ application with the following prayer:

"That the Petitioner therefore prays that this Hon'ble Court may graciously be pleased to admit this petition. Issue notice to the opposite Parties.

By considering the facts and grounds states above this Hon'ble Court may direct the service of the Petitioner may regularized with effect from the date he has completed five years from the date of joining as per letter No.924/FE (G)-05 of 2008 dated 01.02.2016 from the Engineer in Chief Rural Water Supply and Sanitation Odisha, Bhubaneswar with all financial benefits soon par with others. Pursuant to the order passed in O.A.No.827 of 2014 confirmed by the Hon'ble High Court in OJ.C.No.9627 of 1999 and Civil Appeal No.935 of 1999 by the Hon'ble Apex Court.

And further be pleased to pass any other appropriate writ/writs, order/orders, direction/directions as this Hon'ble Court deems fit and proper for ends of justice.

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation before the Engineer-in-Chief, Rural Water Supply & /Sanitation, Odisha, Bhubaneswar, Opposite Party No.3 on 06.11.2021 under Annexure-5. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.3 to consider the representation of the Petitioner under Annexure-5 within a stipulated period of time.

Learned Additional Standing Counsel submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.3, which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party no.3 to consider the representation of the Petitioner under Annexure-5 in accordance with law within a period of three months from the date of production of certified copy of this order. The Opposite Party No.3 shall do well to dispose of the representation of the Petitioner under Annexure-5 by passing a speaking and reasoned order. The decision so taken on the representation of the Petitioner, shall be communicated to the Petitioner within a period of two weeks thereafter. 7.

With the aforesaid observation, the writ application stands disposed of.
