Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner has been arrested in connection with Dharakote P.S. Case No. 117 of 2021 corresponding to G.R. Case No. 864 of 2021 pending in the court of learned J.M.F.C., Aska for the alleged commission of offence under Sections 302/34 of IPC. 4.

Having regard to the severity of the allegations and the availability of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore rejected. It is open to the petitioner to renew his prayer after examination of some material witnesses in the case including Prakash Swain, Satyanarayan Swain and Laxman Palei, who are said to be the eye witnesses to the occurrence. 5.

The BLAPL is accordingly rejected.
